… to EU institutions and Member States. This is precisely the reason why the EEA was set up by Regulation 1210/1990 . In particular, the EEA not only publishes a report on the state of the environment every five years, but it also elaborates more targeted reports on specific issues. Moreover, it plays a role in the implementation and enforcement phases, assisting the Commission in the monitoring and assessment of the application of EU benchmarks. It is also entrusted with the setting up and …
In European societies, Female Genital Mutilation/Cutting FGM/C is regarded as an alien cultural practice that should not be part of society.
… of “practical and effective” freedoms, we have, without much noticing it, fallen into a different hole. The first move in the defence of social rights is the idea that human rights are protections of fundamental human interests (compare with Mill Utilitarianism, Ch. V ). These interests, if taken seriously, need to be protected not just against actions, but also against omissions, or against actions of third parties. This is where the ubiquitous respect, protect and fulfill doctrine has its … very valuable, we know that freedom of religion is very valuable, we know that it is better to leave a guilty person free than to convict the innocent. But this is now ready to change. As the world of economists, policymakers and development experts starts to fully integrate into the world of human rights, human rights lawyers will not be able to stand on their sensibility and what they know to be valuable. They will have to put up (the numbers) or shut up; shut up and let go of their irrational phobia of convicting the innocent. The endgame of the dilution of human rights into the management of human interests can already be seen in the Sustainable Development Goals (SDGs) and allied enterprises. The SDGs are a list of targets for donors, states, NGOs and IGOs that embody the idea of development, understood sensibly enough, in terms of human freedoms, capabilities, opportunities and so forth. But development is about money. Once everything has a price tag, there will …
… unprecedented opportunity to solve some of society’s most challenging problems, from widening disparities in school achievement and economic productivity to costly health problems across the lifespan. Understanding how the experiences children have starting at birth, even prenatally, affect lifelong outcomes – combined with new knowledge about the core capabilities adults need to thrive as parents and in the workplace – provides a strong foundation upon which policymakers and civic leaders can … come into effect in half of the UN membership) as a legal basis for informing and assisting adults in relation to Positive Parenting . Much more is needed, however, to close the gap between theory, reality ánd opportunity. Debate should finally get started on creating a legal basis for an empowerment system of Prepared Parenthood. In 2012, I introduced the SMECC model as a children’s rights based framework for such an integrated system (google: It takes a SMECC to raise a child or SMECC Willems ). In 2014, I started a project, funded by the Elisabeth Children’s Fund , called Early Childhood and Structural Prevention of Child Maltreatment , to investigate why a system of prepared parenthood is so difficult to realize. The first phase of this project …
… of the [information] exchange”. In my view, the Public Prosecutor’s Office therefore rightly concludes that on the basis of this convention, “police forces and judicial services cooperate more closely with local administrations to exchange more targeted information on organised crime (administrative action) in accordance with national law.” (also see the article in Kortom ). There is certainly an opportunity to intensify the discussion of the concept of the integrated approach between … the Convention from the beginning. Europeanization of Albanian Competition Law and Transposition of the ECN + Directive The process of Europeanization of Albanian competition law started in 2003, when the new Law 9121/2003 ‘On the Protection of Competition’, was drafted by the Competition Department with the assistance of Deutsche Gesellschaft für Technische Zusammenarbeit (GIZ). … tackles two horns of the dilemma the EU is currently headed towards. The complicity of doing nothing about democratic and rule of law backsliding in a Member State and the fact that continued supranational integration with an autocratic state would tarnish the legitimacy of all EU-level law and policy. That is not to say that these courses of action are, currently, politically realistic or even desirable. We are not there yet. But clarity over the possibility of member states committed to EU … values. What is clear is that a line must be drawn in the sand whereby Member States committed to democracy and the rule of law say ‘to here and no further’. The alternative is saying ‘anything goes’. Such defeatism politically empowers authoritarian actors, by putting the biggest and most important ball fully in their court. In our opinion a bolder approach is politically warranted, legally possible and credible. The stakes are simply too high for fatalism about EU membership. Written by …
