Data flows across borders: where do we draw the line?

How can we protect cross-border intangible goods – such as personal data or a person’s reputation – on a legal basis? This lecture by Professor Marta Pertegás goes into solutions, challenges and difficulties, using recent examples, such as the Google judgement on the ‘the right to be forgotten’ or the worldwide order requesting Facebook to remove allegedly defamatory material.

How should we address the law-making of such globally relevant cases? Moreover, should truly transnational solutions remain elusive, how do we at least ensure connected legal systems and enforced judgements across borders? (lecture in English)

About the speaker

Professor Marta Pertegás is the current holder of the Chair on Private International Law and Transnational Law at the Faculty of Law of Maastricht University. She joined Maastricht University in 2018 after serving as an international civil servant in the field of private international law for almost a decade. Professor Pertegás possesses practical experience in law codification and treaty negotiations, as well as a wide international network. She also holds positions at Antwerp University and at the University of Johannesburg. Her main research areas of interest are the function of private international law in the interaction between legal orders, the relationship between global and regional private international law, and the transformative effects of globalisation in (private) law. 

This lecture is part of traditional series of lectures for alumni: the UM Star Lectures. The other 13 lectures are organized in 13 different cities and 5 countries on the same day, at the same time. This event is organised to reach out to and inspire alumni, share academic insights, experiences and memories, and to create an interconnected UM Alumni Community.
