"The Legal Framework of Intervention by Invitation"

Intervention by invitation is a lawful manner in which states can use force. One state invites another state to assist it with military means against the actions of usually non-state actors. However, much of this topic remains underexplored in contemporary scholarship. This goes especially for its legal framework. While issues such as the legality of intervention by invitation during a civil war get much attention, the doctrinal foundations of the concept are ignored. This thesis therefore sought to clarify the legal concept of intervention by invitation and positioned it within the system of the rules on the use of force (jus ad bellum) under public international law. The aim was to identify the doctrinal foundations of the legal framework. In this thesis, legal framework comprised the concept’s definition, legal basis, criteria, legal parameters, and demarcation.
