"Conflict of Law Rules under the European Patent Convention - many Conflicts, no Law?"
 

Different from organisations set up within the framework of European Community Law, the European Patent Office (EPO) operates on the basis of a stand-alone treaty, the European Patent Convention. This treaty only partially defines the relationship between the EPO and institutions that operate on a national level, for example national courts that are called upon to enforce European patents. Even less defined are the rules if and when to apply foreign laws to situations unregulated by the EPC. The practice of the Boards of Appeals in this regard have become the subject of a more widespread debate in the context of the transfer of priority rights.​
