Special Issue on European (Union) Property Law in the Weekblad voor Privaatrecht, Notariaat en Registratie (Private Law, Notariat and Registration Weekly) v

On 26 October M-EPLI fellow Sjef van Erp was guest editor of a special issue of the influential, Dutch language, Weekblad voor Privaatrecht, Notariaat en Registratie (WPNR) (issue 6992) on European Property Law. Contributing to this issue were M-EPLI fellow Eveline Ramaekers, Vincent Sagaert from the Catholic University of Leuven, Wim Louwman and Jacques Vos of the European Land Registry Association (ELRA), and myself.

The issue starts with a general introduction on the effects of European Union law on Dutch private law, in which I explore the normal effects of EU legislation, but also the effects of the four EU freedoms on national private law. Vincent Sagaert then contributes on the effects of the financial crisis on the harmonisation of the European mortgage market. Wim Louwman and Jacques Vos write about the challenges the EU integration process brings to land registrars, especially concerning the transfer of land situated in another country. The issues is completed by Eveline Ramaekers who compares the different approaches to the private international law Lex Rei Sitae rule in English and Dutch law.

It is the first time that an influential national journal in the Netherlands pays attention to the development of European property law. It is, naturally, in Dutch, which limits the debate on the substantial questions from an EU perspective, but hopefully opens the debate at the national level.
